TERMS AND CONDITIONS OF SALE AND BOOKING
1. GENERAL INFORMATION These Terms and Conditions of Sale and Booking govern the reservation and rental of accommodations through San Martín Tarifa SL, operating under Tarifa Chic (hereinafter, «the Company» or «we»). By making a booking, the guest (hereinafter, «the Guest» or «you») agrees to these terms.
2. BOOKING PROCESS 2.1. Bookings can be made through our website (tarifachic.com), by email at hola@tarifachic.com, via WhatsApp, or through authorized third-party platforms.
2.2. A booking is only confirmed once you receive a confirmation email from us.
2.3. We reserve the right to cancel or refuse a booking if payment is not received within the required time frame.
3. PRICES AND PAYMENTS
3.1. Prices are displayed in euros (€) and include applicable taxes unless stated otherwise.
3.2. Payment methods accepted: credit/debit card, bank transfer, or Bitcoin (BTC).
Bitcoin Payment Policy When paying with Bitcoin (BTC), the transaction is considered completed in its equivalent value in euros (€) once it has received a minimum of three (3) confirmations on the Bitcoin blockchain.
In case of cancellation, any applicable refund will be processed in Bitcoin, based on the euro (€) amount originally paid, converted to BTC at the exchange rate at the time the refund is processed. However, under no circumstances will the refunded amount exceed the BTC amount initially received.
The Bitcoin (BTC) to Euro (€) exchange rate will be determined based on the official rate published on a reliable exchange source at the time of payment or refund. Tarifa Chic reserves the right to select the reference exchange rate from sources such as CoinMarketCap, Binance, Kraken, or Coinbase at its sole discretion. The chosen exchange rate source will be communicated to the Guest upon request and will be stated in the payment confirmation.
At the time of:
- Payment: The exchange rate at the moment the transaction receives a minimum of three (3) confirmations on the Bitcoin blockchain.
- Refund: The exchange rate at the moment the refund is processed, regardless of when it was requested.
By choosing to pay with Bitcoin, the customer acknowledges and accepts this policy, as well as the exchange rate risks associated with the payment method they have chosen.
We are not responsible for any loss due to Bitcoin price fluctuations before, during, or after the transaction.
3.3. A deposit may be required to secure the booking, with the remaining balance due before check-in, as specified in the booking confirmation.
3.4. A security deposit may be required, refundable upon check-out after verifying the property’s condition.
4. CANCELLATION AND MODIFICATION POLICY 4.1. Cancellation terms vary depending on the booking rate selected at the time of reservation.
4.2. Cancellations must be made at least 30 days before the check-in date to receive a full refund. For reservations in June, July, August, and September, cancellations must be made at least 60 days in advance to receive a full refund.
4.3. Cancellations outside this period may incur a charge, up to the full booking amount.
4.4. Booking modifications are subject to availability and may involve additional charges.
5. RULES OF STAY 5.1. Check-in is from 17:00 and check-out is by 11:00. Tarifa Chic will make every effort to accommodate the Guest’s needs regarding check-in and check-out times, but does not guarantee that changes will always be possible. Any modification to these times must be agreed upon by both parties. Failure to respect these times will result in a financial penalty of 20% of the nightly rate per hour of delay.
5.2. The maximum occupancy of the accommodation must not be exceeded.
5.3. Guests must leave the accommodation in good condition. This includes removing and disposing of their trash in the designated street containers, cleaning any used dishes, cutlery, and glassware, turning off electrical appliances, and properly closing taps, doors, and windows before check-out.
5.4. All guests are required to register through an external application that securely transmits their details to the authorities, as mandated by law. This registration must be completed before check-in without exceptions. The current registration application used is Partee.es, but this may be subject to change. This application uses encrypted technology, ensuring the safety and confidentiality of the information provided. Using this system is a more secure way to submit personal data compared to traditional methods.
5.5. The use of the accommodation for any purpose other than temporary tourist lodging is strictly prohibited. This includes, but is not limited to, parties, commercial events of any kind, filming of advertisements or any other productions, and photoshoots.
5.6. Smoking inside the property is strictly prohibited.
5.7. Pets are only allowed if explicitly permitted in the booking confirmation. However, guide dogs are always allowed.
6. LIABILITY AND INSURANCE 6.1. The Guest is responsible for any damages caused to the property or its contents.
6.2. The Company is not liable for personal injuries, lost items, or force majeure events (e.g., power outages, natural disasters).
6.3. We recommend obtaining travel insurance to cover unforeseen circumstances.
7. DATA PROTECTION 7.1. Personal data collected during the booking process is used exclusively for managing the reservation and in accordance with our Privacy Policy.
7.2. Guests’ information will not be shared with third parties except when required by law or necessary for processing the booking.
8. APPLICABLE LAW AND JURISDICTION 8.1. These Terms and Conditions are governed by Spanish law.
8.2. Any disputes shall be subject to the jurisdiction of the competent courts in Algeciras, unless otherwise required by applicable law.
